Child maintenance if no income?

Apologies if this has been done to death. I have googled with no success.

The police officer I talked to this morning while I made a statement re exH told me I am entitled to CM even if H doesn't have an income. He said H will build a debt and will be able to start clearing it once he works again.

I can't find anything that supports this. Any ideas? Thank you.

No. Cm is based on income, so no income = no cm. He can be found liable for maintenance, but it would be a nil award.

Hahaha ha I wish.

changewhale · 24/05/2023 14:59

So he's not getting any benefits at all?

FloweryName · 24/05/2023 15:02

That’s not true. If he’s claiming benefits you can apply for CMS but you will get very little if anything.

It would be great if all parents who can’t afford their children get into debt with the state for the money it provides them with, but that’s not how it works.

He can't have no income. You can't live off fresh air. Do you mean no earned income, i.e. wages?

ItsBritneyBitchhhh · 24/05/2023 15:04

Erm no. If he’s not even getting benefits then you can’t get fuck all. I know because my kid’s dad has £0 to his name and I can’t claim CMS when there’s no income

Trust me, it really is possible to have no income at all! As long as the person has somewhere to live then they can happily be a bum

millymollymoomoo · 24/05/2023 15:26

It’s not correct
hed be given a nil assessment or £7 a wk or something if on benefits

No, he receives nothing. Doesn't claim benefits. He has savings.

Savings aren’t income, so you won’t be able to claim child maintenance.
Whoever told you that you can is talking rubbish I’m afraid

Fourmagpies · 24/05/2023 21:09

I've been in the same situation, STBXH has no income, living off savings and I don't get anything. Will only start to get child maintenance once he is earning again. And nothing accrued in that time.
