How long after applying for decree absolute will divorce be granted?

Hi, my partner is currently 20 days away from applying for his Nisi, once that’s in I know it takes 6 weeks and 1 day till you can apply for the absolute. How long after applying for the absolute will it take to come through? We marry the 18th August, 6 weeks and 1 day from applying for Nisi is the 6th July, hoping it comes through that week so we can give our 29 days notice for marriage? Cutting it fine I know but we’ve brought the wedding forward 4 months due to me finding out I’m pregnant! I’ve seen some say online it takes a few hours or a day to grant the final divorce. Some say it takes week. There was no financial aspects as neither parties have anything, she has agreed to the first part of divorce and signed it and sent it back, can she say no to the Nisi? Thanks for any help! This is with the new no fault divorce. Thank you x

@Meg1313 He should still apply for financial consent / clean break order so that they are legally separated on a financial basis too !! Just doing the divorce part means at later date she could come back and try to get assets from him ( ie inheritance / lottery win etc....)

  • you can only submit this once you have your conditional order - it is not a good idea to go for a final order until the financial consent / clean break order has been approved by the courts as any queries / problems can be sorted while they are still legally married.

Once the courts approved our financial consent / clean break order - I applied for final order and got a reply within three hours........

how long did it take for the conditional order to be granted for you? It says a few weeks online including the 6 weeks and 1 day. I thought it wasn’t that long 🙈

@Meg1313 - you will get an email saying you can apply for conditional order after the 20 week waiting period is up on the original application for a divorce - the other party has to reply too - the gap between applying for the conditional order and the request being accepted was nine days then it had to read out in court and was granted 15 days later - I then had to wait 6 week and 1 day after it being read out in court before being able to apply for a final order.

@2022NewTimes eek, i didn’t think it was that long. He can apply for conditional order on the 23rd of this month, then our wedding is the 18th August. Hopefully we get it in time to give our notice! The register office did ring and say we could possibly give our notice before then bring the final order in once it’s through. Hopefully!

I applied for my conditional order 21 March and heard nothing , after 5 weeks and several messages I was told there was a admin clarification ? I wasn’t aware of this … my solicitor sent an email stating my disappointment on Thursday 4th and Friday 5th it was granted . Now I have to wait until 16th June to apply for Final 😊

They refused to issue my absolute without me and ex going in person to a local court, because the judge thought that our finances looked unfair in our financial order.

Personally I think you are crazy to think it will be done and dusted by August. Can you delay the wedding?

Financial consent order once finally agreed took about 2 weeks, then the absolute took 2 hours from application (was an online one)

Hi does anyone know if the final order certificate (decree absolute ) new no fault divorce is issued online or posted ? And time scales for receiving the certificate . I am able to apply 16th June Thank you

@Plankingplanks there’s no financial bits it’s all a straightforward divorce :) I’ve seen people getting their absolutes around 8 weeks after applying for nisi (online no fault divorce) we’ve moved the wedding to October now anyway :)

@Zahraoui25 we’ve not got to that yet but my partners divorce is the online no fault and I think it’s only online then you have to get it printed yourself? I may be wrong though!!

@Meg1313 @Zahraoui25 approximately 2 hours, if that! Email came through at midnight, I logged on at 6am, and it was done by 8am!

Yes - when you apply for the divorce they confirm receipt of your application. They email you once checked by court staff to confirm if your application has been accepted. They then ask the other party to respond. You should receive an email which will tell you from what date you can apply for a conditional order.

The next step is for you to apply for a ‘conditional order’. A conditional order is a document that
says the court does not see any reason why you cannot get a divorce.
You can apply for a conditional order on 7 January 2023. This is because you have to wait until 20
weeks from when the divorce application was issued. You will receive an email to remind you.
