Divorce in Scotland when you married overseas?

Husband and I are splitting up, married 3 years, no kids. I bought the house a couple of years ago, he's not on the deeds or mortgage as he's here on a spouse visa. We got married in the US.

I was thinking we could just separate and he'd go back to his own country (where he has a home) and we could divorce after 2 years passed? But my friend said best to do it before he leaves to avoid any issues later on? I didn't know this was possible. Any advice please?

Your friend is probably right but you should see a solicitor. You certainly wouldn’t want him filing in somewhere like California if that is possible.

Thank you. He's not from the US originally we just got married there as it was a midway point for us both.

Thing is he'll likely be leaving next month if not before so I don't have much time to act.
