Husband I'm Divorcing continued claiming Housing Benefits for his Social Housing, not living there

Abusive husband I'm divorcing claimed housing benefit for social housing he no longer needed for 13 months after we got married - is this fraud (he was living with me)? Sounds like it to me...difficult to tell from Gov website, it seems that you can still keep some benefits even if you're found to be committing fraud!

He should have given up his social housing when he moved in with you, what happened to that house. How did you find out, does your solicitor know.

If he was no longer living there then he shouldn’t have been paid housing benefit for it. So yes if he received while living with you then that’s was wrong and if found out he would have to pay it back.

whether or not it is classed as fraud is another matter but it doesn’t have to be fraud for him to have to pay it back. I don't know about if he could still keep the tenancy going for the social housing
