Xdw cleared our savings account

After last night's disagreement I woke up this morning to bring shouted at my W and telling me she is going to divorce me. She will move out to one of her rental properties.

I checked our joint account and she has taken the full 10k out. This money was both of ours from the sale of the lease on one of our flats.

What can I do to get my half back?

I have not got a penny to instruct solicitors

Simply put you can't as it is in a joint account in both your names so she can do as she pleases with it. If you do divorce however you can include this figure with the evidence for consideration for the financial hearing and decision. So sorry - it sounds like it came as a shock!

As PP said there isn't anything you can do to get it back as it was in a joint account. Of course you can use this money as a bargaining tool when it comes to the finances, which is a long way off I know.

Yeah, this is one of those "exceptional circumstances" in division of assets. This will be counted as part of her share.

Just borrow against the house to take her to court. She might have to pay that too because of her behaviour, speak to a solicitor.

You might find they don’t need paying until the divorce settlement goes through? Someone else will know.

How many rental properties does she have?
How much are they worth?
How long were you together?
Any kids? Who has them?

You own half her rental properties (probably)
Does she know that?

My cousin's wife cleared a joint account -- she got a boob job with the money ($20k).
I understand that He got the condo.

ps: they were members of a pious religious minority before she emptied the bank account. Can't make this stuff up.

We have 2 flats that are in negative equity.

Worth approx. 85k each in both names
