What happens to remortgage when partner's home rights application is approved?

Hello,

I have applied for divorce in May 2021.

Just today, I got to know from my house remortgage solicitor that my wife has applied for home rights application to the land registry in June 2021. Even though she has left UK by end of May and not participating in the UK divorce process.

This is actually possible even if the house title deeds & house loan is on my name. I bought this house in 2016, got married outside of the UK in 2020, came back to the UK with my partner in Jan 2021 (late due to pandemic).

Only after divorce is granted here, I’ll then be able to sell the house or ask the land registry to remove her home rights.

But I need to apply for remortgage as the current fixed term product ends soon and then the variable rate will start which will be expensive.

Has anyone dealt with such issue before? Will her land registry application approval cause any blocker to my remortgage process?

Also, the land registry application type is Dealing and I have the reference number but no other information as such.

Please help 🙏

You won't be able to remortgage without your wife's permission The standard rate is about 4% which isn't too bad you'll just have to pay that till the divorce is finalised.
