Morning all stbxh and I have agreed financial split and waiting for solicitors to get back to me with fixed fee price to draft order. Neither of us have much saving to speak of so want to pay as little as possible in solicitors fees. Although after lots of googling I am worried order may not be approved could anyone whose been through this give me opinion.
House worth 600,000 mortgage 292500. Dad loaned us 60000 to get property stbxh isn't contesting this and agreed we will leave this in cost of property not to be divided. Split what's left 55-45 my favour I will keep house will have children residing with me 70 % of time. I will pay him 111,000as soon as can parent are likely to assist me with this so can keep children in the house can get mortgage myself just. Throughout marriage 10years I have two period of maternity and worked part-time therefore lost out on pension payments. We both have good police pensions worth similar mine bit more do to taking promotion he chose not to. Neither have significant savings and neither have debts I am worried courts will not sign off as made complicated due to dad's loans and my pension being more. From my view I am the only one who lost out during marriage as pension was affected. I have the kids 4 night a week so potential to earn overtime considerably less than his he can work it 4 days a week. Can anyone give me knowledgeable opinion. Thank you. To note since day he moved out I have paid mortgage and all bills on own region of 2600 he pays 500 child maintenance and rents a room.

I hope you get some good advice. I'm in a similar position and interested in any responses you get.

Does make me wonder whether the expense and hassle of a consent order is worth it when both parties have completely agreed the finance, just for a judge to potentially throw it out!!

Good luck to you

Nothing yet. We have rang round today cheapest price 1050 we are going to look at online options as not prepared to pay that for something we have agreed ourselves

We did an online clean break order. We agreed all the split up front. I am much higher earner and always paid more into the house etc (paid for probably 80% of it). He earned less because he couldn’t be bothered trying for promotion- you don’t need to when someone else is paying for everything! We split everything 50/50. House equity, Pensions etc. We split childcare 50/50 too. I pay for most childcare costs (school fees, buses, uniforms etc) all Christmas and birthday gifts, and maintain holiday home until our children are 18. Cleanbreak.co.Uk were a pain in the neck - took forever to draft the order which created issues but the process is straight forward enough. Good luck with yours I hope you manage to gain a successful outcome
