Things v bad between dh and I. I'm considering all my options. I would like to know where I would stand with residency...I know dh would want 50/50 but for various reasons I'm unsure how well that would work. At what age do the courts take childrens views into account? And how much does their opinion count? Thank you.

It might be worth getting this moved to the Scotsnet section?

My understanding is that primary-aged children are old enough to express a view, but not to make a final decision.

The waiting times for courts are horrendous (at least 8-12m plus) and likely to increase further - so you really are best to try & resolve it yourselves.

I'm in the same scenario - have an ex-P who has had very little involvement in the DC's day-to-day life but now wants 50/50 to avoid maintenance - a nasty piece of work.
