Ex has ended maintenance - is Art Foundation Secondary or Further Education?

My daughter turned 18 last month, has just done 3 Art A Levels and will be doing Art Foundation next year, before applying to University to do Graphics. This is the usual path into an art degree (to build her portfolio etc). I had always thought this year would be a part of her Secondary Education.

My Ex husband has stopped her maintenance payments, which will leave me with a large shortfall for a year. He’s phoned the college and the receptionist told him Art Foundation is Further Education, not Secondary.

I’m now overdrawn - as I didn’t see this coming - not sure what to do.

If she still qualifies under child benefit and tax credit she us atill classrd as a child under child support law. If he will not pay maintenace voluntarily open a case with the CSA.

I’m in Scotland so maybe different, I am going through the same my solicitor has told me he is financially responsible until she’s I think 21 and in full time education but responsible to my DD not me. He was paying her student rent but she has moved home with me due to covid and he hasn’t paid a penny since March. My DD will have to take him to court which she says she will as he’s been such a twat to her, if it were me I’d tell him to stick it. She is getting a bursary now and will be at home for the foreseeable as no point paying rent in a city when all online. Maybe she should move back as he says he’ll pay her rent!! You honestly couldn’t make it up!
