He's buying a house before the decree nisi

STBXH is I think buying a house before we've been issued with the decree nisi, it is imminent but it appears so is his move.

He refuses to deal with the money side of things so it's going to have to go through the courts. I am entitled to 50% but he's refusing to give me anything.

What do you suggest or think will happen?

The decree nisi is the first stage of divorce, you are not divorced until the decree absolute and before then any financial matters are usually settled.

Generally speaking you will be entitled to 50% on any marital assets, possibly more depending on children, earning potential and other factors.

If he is buying a house before you are officially divorced, then he's not very clever! Get yourself some advice though!

It is in the hands of the solicitor, but if they don't know what he's up to it's a bit difficult to figure out what's happening.

It’s daft until he knows his financials and wouldn’t be something a lender would like to see. But at the end of the day he is turning cash into an asset. You’ll still be entitled to 50%

Are you joint owners of the current house? The solicitors will need to see consent order to take your name off current mortgage.

We both rent our own houses, we've been separated over a year now.

He's intending on giving me nothing financially.

Note we own a business together, value of 500k which he's trying to keep everything of.

Well he can try all he damn well likes to keep everything. But it won't happen. Your solicitor will know best so listen to them.

How does he propose to keep all the business? If it's jointly owned he has to buy you out. Get your solicitor on this and get started on the consent order. Unless he has other assets elsewhere though it doesn't seem a great plan...

I bought a house before nisi, I had to, I had nowhere else to live and wasn't going to rent. As long as everyone gets their fair share...(Which as others have said, isn't necessarily 50% - I took 28%).
