Hi, he's in the process of moving house and I won't have his new address (no kids together) can I get him served at work? Is there another way for the divorce to proceed? He's most likely just been as awkward and hateful as possible so no chance of reasoning with him

Yes, you will have to get him served. If you go on the gov.uk website it will tell you your options

Been there, done this!

All you have to do is ‘prove’ he was served. Copy of postal receipt, texts to say he’s not signing etc. Then after 28 days go to court fill out form D11 pay £2 and the application will go to the judge within 28 days following. It is surprising easy if you can prove it!

My ex claimed he lost it! This was in front of a judge in court! Luckily he was served

I have emails saying he has the papers and he intends to send them back (obviously just so I don't do anything). £2 seems a bargain!! Mind you it should be cheap because I don't believe I will get any costs from him because he will choose not to pay.

You only have to give him 28 days to sign and return
,if he hasn’t go to the court!

Thank you, filled in form D11 today. I have to say the divorce web chat on the government website was brilliant, she answered all my questions and talked me through what to do next, it's a very good service

Although it's £50 not £2

When I applied ( as part of abusive divorce) it was only £2! I’m sorry that you had to pay £50, but that is still a good deal to be rid !!

yesterdaystotalsteps123 · 01/02/2020 08:21

Yes it's well worth it! The web chat person said the judge will decide who has to pay divorce costs now it has come to this so he may be ordered to pay me back anyway. Not that he would, but it's still a good feeling when they still cling on to their control and you can still get on with divorcing their abusive arses,!

My ex did this. Refused to sign anything. I paid for a bailiff to serve him the papers but she couldn’t and he would not answer the door. In the end because I had text messages confirming from him that he had had the papers but wouldn’t sign them, the judge accepted this!
