Hello everyone,

Anyone with the divorce process ongoing?

It seems to me the second half of the year BSE Courts has became faster in processing, correct me if Im wrong.

I have filled the divorce on 8th July and it was issued 22nd July.
AoS was sent back to Court by my STBX in 06th August and I applied for the decree nisi in 29th August.

No return from court yet about the DN pronouncement.

Someone knows if still will take long for me to hear from the court about my nisi?
I can't wait for this nightmare to be over

I'm with BSE. I originally filed for divorce in November 2018. There were a couple of delays (they sent me back the paperwork, I revised and sent straight back). I got my decree nisi in September 2019...
Sorry about the bad news, the nightmare continues.
Personally I'm not that bothered because we still haven't sorted a financial agreement. Sigh.
It sucks being in limbo but we just try to get on living separately.

agss · 10/10/2019 23:46

@Spritesobright 10 months to recieve your Decree Nisi? This is absolutely insane!
I don't know how Im gonna cope with that.

Do you remember the date you applied for the Nisi?

OP posts:
Tiddleypops · 11/10/2019 07:39

I applied in December. They cashed the cheque and lost the paperwork. I reapplied in Feb (once I knew they'd lost everything). Nisi application went in mid May but there was a minor typo so I had to sort that out which bumped me back to the end of the queue again.

Anyway, I reapplied for Nisi 16th Aug so just a few days before you. I rang up this week...
It was sent to legal team 10th Sept.
It was approved by legal advisor (thank f×××) on 30th Sept.
It's now in the queue waiting for a pronouncement date (and I understand 4 weeks notice is given for this, so even once a date is set out will be at least another 4 weeks in the future, but I could be wrong). So it will be end of Nov at least Sad

@Tiddleypops Oh thank you, there is still a bit of hope! Im looking forward to recieve any information from the court. One question, have you call yourself to the Court or your solicitor?

OP posts:
Tiddleypops · 12/10/2019 05:42

Sorry slightly misleading, I called myself but the number on the website is not actually BSE, it's some central office in Leicester!

Anyway, it's 0300 303 0642 - they can at least access your records and tell you where you are up to. Then, they'll tell you where the courts are up to date wise if you see what I mean. So it gives you an idea. The waiting and waiting is just torture isn't it?! If you do call, be prepared to do some more waiting. When I called I was on hold for 25 minutes.

I applied in April and my decree nisi was approved 2/7 and received 22/8 by my solicitor I could have applied for absolute 2/10 and they are pretty much turning them around immediately. I am in process of submitting consent order and can see they are taking approx 3/4 months for those to be authorised so not expecting it to be sorted until jan/Feb time. Which I’m ok with we separated in Feb so 12 months in all x

@Itsallchange thank you for your info. Do you know/heard of anyone who have applied a Clean Break Order instead of a Consent Order?
Would a CBO be any faster?

OP posts:
Itsallchange · 12/10/2019 19:49

Hmm no sorry I haven’t x

agss · 14/10/2019 12:48

@Tiddleypops yes, torturing! Im gonna try to call today, cheers for that. Smile

My Nisi was sent to them in June, should be straight forward...I haven't heard yet. I rang last week and they told me they are still on June, hopefully will get to mine in next couple of weeks.

Itsallchange · 14/10/2019 22:30

@hairtoss according to the info I posted above they are working on nisi applications from sept?
Maybe worth another call stating that? Xx

hairtoss · 14/10/2019 22:37

@Itsallchange
That's why I put my post up...I don't think its quite as efficient as they are making out!
I will ring in a couple of weeks...I'm not in a particular hurry, I don't think my financial remedy will be done til spring.

Itsallchange · 14/10/2019 22:46

The dates matched up my mine went through because I tracked it once I’d known what date the solicitor posted it. Is your financial order ready to go in? X

Tiddleypops · 15/10/2019 03:11

Yes that doesn't sound quite right @hairtoss.
I applied for nisi in August and it's with the legal team shortly to be given a pronouncement date. I would double check. Hope they get you sorted out!

Freeat40 · 17/10/2019 07:44

Has anyone applied for their absolute before their consent order has been approved? My solicitor says as I'm. it claiming pensions it's fine to do.

Itsallchange · 17/10/2019 08:57

@Freeat40 my solicitor advised against it and ours is quite a straight forward no other assets other than the house and agreed mesher order, I could have my absolute but consent only just gone in so reckon another 3 months based on the current delays! Fingers crossed it doesn’t come back as solicitor advised me H did not date it!

Freeat40 · 17/10/2019 10:06

Thanks for your reply. I'm confused as to why my solicitor has recommended it and the advantage/ disadvantage of applying early. I'll ask the question in a new thread!

Freeat40 · 17/10/2019 10:08

But I should add my nici was submitted middle of Sept and will.be heard end of Oct so hopefully this will give hope for users of BSE

agss · 23/10/2019 19:13

Just an update.

I called to the phonenumber provided by @Tiddleypops.

My nisi has passed through the legal team, got approved and now just awaiting a pronouncement date. The court is not able to provide any forecast but I believe it will be very soon.

OP posts:
Tiddleypops · 23/10/2019 19:19

I think it will be soon @agss.
Mine is 7th Nov which is much sooner than I thought - I was expecting them to notify me, and then it be 4 weeks in the future if you see what I mean.

Based on the fact I applied less than a couple of weeks before you, that should give you an idea.

agss · 24/10/2019 15:57

@Tiddleypops that's great news. i'm happy for you and also enlightened my way. It has been such a hassle all this process.

If you dont mind me asking, Did the court send you any e-mail/post/phonecall to let you know when is your pronouncement date? or Did they send to your solicitor?
