my husband left xmas 2016. There has been a dispute with the cms as he has been underpaying for all this time. He is now saying that as he owes over 4000 and cms will be taking 40percent of his earnings he can no longer afford his rental house and will be moving back in. Ihave been advised that i cannot get an occupancy order based on the historical abuse we suffered when he was living here only on incidents that have happened in the past few weeks. our children are 13 14 and we are scared for our safety. we think this may be a bluff and blackmail attempt to try and make me drop the Cms case. he is living in a 4 bed house in town centre with partner and her son. friends say they are happy how could he leave her as she would not be able to pay rent. he also told social services i was not looking after children and house was dirty
