Divorce, buying out of mortgage..

I'm hoping to , so show, but stbxh out of the "family home".

We've got a joint mortgage and have put in pretty much equally, including deposit.

He's had so e time unemployed, and told me he was paying from savings. He was borrowing from his parents so has a debt to them. Equally, I have credit card debt as a result of his time unemployed, and also as a result of continuing to pay half bills/Mortgage when on maternity. He has had a recent inheritance which I am happy to leave along if he leaves my pension alone. I now work part time due to 2 small dc.

So, I am hoping, that we can agree to a fair split of the equity and I can buy him out. He will need the money for a deposit for a new house. I have the 2 dc full time atm.

When he first left (nearly 2 yrs ago) he suggested 50/50.

50/50 only applies to what you both earn during marriage.

Before marriage you can argue it's yours
