Sale of FMH disagreement about method help!

Ex has been ordered to immediately sell the FMH. Equity to split between parties (biased in my favour) but jointly to instruct solicitors and agents. Ex has instructed an agreed agent however is saying that fees to be split in same ratio as equity. Is that right or some thing I should argue?

Doesn't seem unreasonable. Sale fees are jormally percentage-based, so since you are getting more of the equity, why should he end up paying a proportionally much higher sale fee than you?

Does the order not say the proceeds are to be distributed:

A) in payment of mortgage
B) in payment of agent/solicitor fees

And then the surplus be distributed in 60/40 (or whatever) shares thereafter? That’s what I would expect.

Normally agents and solicitors fees come out of equity before the net proceeds of sale are shared.
