Can I claim tax credits ?

I'm separating from DH however he is still yet to find somewhere to go, he isn't financially supporting me or DC at the moment , is abusive if I ask for financial help from him, however he is still paying some of the bills. Is there any possibility I can claim for tax credits whilst still waiting for him to move ?

Yes I believe you can. And in your situation I wouldn't be inclined to inform your Ex you are receiving TC's.

@misstobe I called tax credits this week and told both people I spoke to that he was still paying the mortgage and they said that was fine as long as I had filed for divorce. Must depend who you speak to - maybe try again?

I’m now divorced and in separate houses so it’s no longer an issue

I have heard on MN that it is possible to claim benefits while you are separating but still living in the same house. I think it's to do with if you keep separate finances or not. But it does appear to be more tricky to claim because you have to prove you are not still a couple.
