D11 application for enforcement of order as LIP

I have no money for anymore legal services (still paying off a loan for the cost of legal stuff for the divorce).

I've been divorced since the end of 2016 - have the consent order. Ex hasn't done one of the things in the order (I don't want to say what as he has stalked me here before - twat Hmm ).

I'm going to make an application to court for enforcement. I had a last bit of advice from a solicitor and know how to fill in the form and what to put in the statement. I just wanted to know what happens after I hand the application to the court and it's served on him. Will I get a date for a hearing then? Will I have to get further documents to the court - I'd planned to send my statement and all the documents in support with the application.

What form will any hearing take (divorce went to final hearing but I managed to get him to settle on the morning of the first day).

I'm sure I'll have more questions. Feeling a bit sick that I have to do this - he's a narcissistic abusive arse and I don't even want to be in the same postcode as him, let alone a court room Confused

I'm going through this at the moment. My paperwork has gone backwards and forwards from court to court due to the court not knowing what to do with it/who should deal with it.

Basically, fill in the form stating what you part want to enforce and attach a copy of the order. Send it to the regional divorce unit where your order was approved. That court will then send you both a notice saying that they are moving your order to the court local to where the non-payer resides. This paperwork requests the local court to set a hearing date.

I'm at this stage now and waiting to hear. I am going to request a private meeting with the judge as I am non contact with my Ex due to his very nasty controlling behaviour (non-physical) and I do not want to be in a room with him.

Sorry you're going through this Secret - my ex is nasty and controlling (but non-physical) too - seems perfectly charming to those who don't know him, though.

I was advised to send the application to the court where our hearings were (and near to where both me and my ex live). I don't know what a 'regional divorce unit' is. The order was drawn up at the court before the final hearing, and approved when we went in front of the judge.

I see. Our consent order was approved by the district judge at the regional court who did our actual divorce (Stoke on Trent). We didn't go to court as such as we managed to negotiate our settlement betweeen us and our solicitors.

Ah right. My divorce took over two years as he delayed and obstructed throughout. He made no sensible offers so we went to final hearing (where I got much more than he wanted to give - hence the issue now ...!)

What part of your order are you trying to enforce, if you don't mind me asking?

He didn't make the first maintenance payment.....for no other reason than he didn't want to!

I think your ex and my ex are related .... Hmm

Mine is not about maintenance ... that'll be the next application I'll have to make!
