why is my ex taking so long to declare his finances?

We separated at the start of July 15. He moved out after admitting to another woman. He said he needed until the end of August to get his financial information. It's been over a year and still nothing.

I initiated divorce on a fixed fee thing…but everything had to be done within 6 months and it hasn't. I told him about this at the time. The proceeds from the sale of our house are with my solicitor pending settlement. I can't afford to take him to court as I am now on ESA due to ill health. I'm in rented accommodation, he's in his girlfriends house. I have the kids most of the time, they got to his every other weekend.

Why would he be so reluctant to declare? He earns a good wage- much more than I ever could. Does anyone have an idea about what he might be trying to do- I'm assuming that he's up to no good somehow…but I don't know what he's planning, and I don't know what will happen to the proceeds of the house if he doesn't declare- solicitor wasn't particularly illuminating...

Why are the house proceeds with your solicitor? Is that becasue it was in joint names and you and he agreed they should be held by the solicitor? That sounds likely. You would have thought he would ilke to get his hands on that money or half of it surely even just to buy himself a buy to let even if he's happy sharing a house with his girl friend.

You can force him to progress this by applying for a court hearing of the finances. (Don't get decree absolute until you have a court order on the finances by the way).

the house proceeds were with me (ex left just after we'd sold the house- I didn't want to sell it…) and I was told I had to put the proceeds with my solicitor/his solicitor by his solicitor…or they were going to take me to court.

I'm thinking he wants the house money. Although his partner has her own house, so he is securely housed as this, it turns out, is a long term relationship. I can't afford to take him to court unfortunately as I am on benefits and unable to work at present due to ill health.

there isn't enough money from the house to house both of us, and as it has been sat doing nothing for a year and house prices are going up, the percentage deposit it would represent (if I was working and able to get a mortgage) is rapidly shrinking.

I don't understand why you think you need a solicitor to start the court proceedings starting - you don't?

He may not end up being awarded any of the house funds because you need to house the DC...

How old are the kids

I bet he can't persuade his new girl friend to put her place into joint names (and why should she) so her probably wants some financial security by dividing the proceeds sitting with the solicitor. I agree it would be better if one of you had it invested in a new property although in some areas prices are falling not rising - fallen for a second month in a row in London actually so waiting in some areas is a good idea.
