Divorce proceedings have dragged on and on. Several months after court order ex has not applied to take me off the mortgage or pay the divorce settlement lumpsum. I can not get any loans or just move on with my life (need housing, new car and be able to take business loan) and he is clearly enjoying the control he has.
I am still waiting for my legal aid certificate to be renewed and months later still no news so my lawyer is not doing anything (as he is not gettimg paid IYSWIM).
I want to take matters in my own hands.
Is there anything I can do to get things moving on?
What is the next step to enforce the court order?
I usually try to keep positive but I feel absolutely shit today. Court has gone on for several years.

Did the Court Order have a date by which the requirements had to be fulfilled by both parties?

eloelo · 04/08/2016 21:28

yes it did and it expired several months ago

You need to go back to your solicitor.

I think when dh's ex did similar, they started racking up interest from the expiry date, which motivated her.

it doen't seem to motivate him

You can apply to the court for enforcement.Have a look on their website as they often have detailed information.Maybe ask on Legal
You could also call as they can be friendly and helpful. My friend had a similar situation, ex deciding he would vary Court Order. She got information from the court which she relayed to the ex.He realised she would follow through and his job would be in jeopardy if he did not comply.

Worth trying as his lack of complying isn't treated lightly
