School - ex partner taking me to court

Ex partner is 1.5hrs away & it was agreed last year that she would school with me.

She didn't get the school id like around here so we have decided to move closer to family on new partners side & also to child's father (closer by 30 mins) so that we do it before school year starts. Quick summer move!

However the school we've been allocated is RI & now her father is not happy & is going to take me to court as he wants child to move to him & school with him at outstanding school.

However we also know that she's number 1 and number 2 on waiting lists at two other schools near me, that are both rated Good. So hopefully she'll get a place & all of this can go away! But also maybe not as waiting lists might not move!

Anyone have experience of this?! If so, what's your thoughts?

We currently have a flexible arrangement as she's not at school so can each spend more time with her. It's about 60% me, 40% him.

If he hasn't issued yet, he'll have a job getting a decision by September, so what he wants would mean her starting secondary with you, and then moving school and primary carer part way through the school year.

I can't see that happening unless there's some other compelling reason for a change of reidence to be added to all the other changes.

What happens if he just starts her at his school without my permission?

All the school applications so far have been with me, she has a place allocated near my residence.

But he says he has a place for her at school near him. What if he just starts her there!?

He shouldn't be able to get a place at one school without ditching the place you have, although with academisation and free schools I'm not sure how well that now works.

Your local authority's school admissions dept may be able to help there. And the one covering the school he claims to have a place at. They need to know the situation, if he has somehow got her a place.

I suspect he's lying though. If he tries to pull a stunt like that after 3 years separation he will be getting himself a world of pain in court.

How does your daughter feel about it?

Neither schools are free schools or academic.

I'll drop his school admissions an email today to let them know the situation.

Daughter doesn't know.. she's only 4, so very adaptable

The school she had allocated before we moved none if her preschool friends were going there so she'll know noone wherever she goes

He's so annoyed though that I Wouldn't put anything past him right now

Quick question what constitues a resident parent?

In what context?

Who gets Child Benefit? In our local authority, you couldn't apply to the school if you weren't the receiving parent.
