Hello, I have posted many times regarding my situation. Twins aged 11 boy and girl, just started secondary school in September. Father has been abusing us mentally, emotionaly and verbally. He continues to swear at the children now and then when he gets angry and continues to insult me to them whenever he sees them and to me via email/verbal. He doesn't agree with me being the primary carer and after the first hearing, he is to make an application to that effect and a full CAFCASS report has now been ordered to be in court by 15th April. We are to go back to court the first available date after end of April.
DS is quite possibly going to say that he wants to live with both of us, separately of course and at the moment dd could either say the same or that she wants to live with me.
They both live with me in the former matrimonial home since June 2014 when I removed stbxh with a occupation order and has since been advised by social services and police to not go back to live.
He is simply a bully, he has never said that I couldn't look after the children adequately before we split but simply won't accept that his behaviour is abuse and whatever behaviour he exhibits he then emails me complaining that I am exhibiting this.
Does anyone know what CAFCASS will advise if both children say they want to live with both of us. Obviously reports will be obtained from my dd's counsellor at her school and ds's school and gp as to how this is all affecting them, but as they have been living with me since June, I am the one that has been keeping the house/mortgage/bills going since the beginning of 2014 on my own and looking after the children primarily would CAFCASS really advise that he be the primary carer? I believe 50/50 is out of the question as stbxh never agrees with me on anything and if I say it's black he'll say it's white, I don't believe that will improve for many years and by that time the children will be old enough to actually voice their feelings to their dad in any case.
If anyone has any experience please please could you explain how this all works.
