So me and hubby joint claim. I’m not working as care for my child who disabled. Partner self employed. Recently UC asked to do a review so want bank statements etc which have been provided. My only worry is that quite often various family and friends help us out with money so it’s obviously different peoples names shown on the bank statement. Could be 100 one week or maybe 50 here and there another week. Sometimes around 200. Just depends what we need. But it’s not income it’s gifts but I’m still worried they will question it and we will be in trouble. Savings are below £1,000. Anyone here work for UC who can advise or has been through a review with circumstances to mine above

They will drill into who the people are, because of how suspicious it looks with your partner being self-employed.

In terms of the amounts you are receiving from various friends and family members, how do they stack up next to the types of payment he is receiving?

Does he normally invoice?

Is it a similar amount?

Who are the friends, and what sort of amounts are we talking, how many transactions in a month?

She must have been receiving the money in exchange for something, like cleaning for their relative or helping them with something. Because they do no class gifts from relative as income, even if it is a regular monthly payment. Again, you can check this yourself.

I don’t need to check it out thank you because I have never claimed a benefit in my life. What you are saying is that you could be gifted 5000 every month and still be able to claim UC….

H1021 A payment is capital if it is

  1. not made or due to be made regularly and
  2. made without reference to a period.

The payment is income if this does not apply

"H5002 [See Memo ADM 20/20] A claimant’s unearned income means1
any of their income consisting of

  1. retirement pension income
  2. beneft income
  3. foreign benefts
  4. spousal maintenance
  5. student income (see ADM Chapter H6 for guidance on student income) 6. employment and training payments paid

6.1 as a substitute for UC or
6.2 for a person’s living expenses

  1. sports awards
  2. certain insurance payments
  3. income from an annuity
  4. sports awards
  5. certain insurance payments
  6. income from an annuity
10. income from a trust 11. income deemed to yield from capital (sometimes also known as “tariff income”) 12. capital treated as income 13. certain income which is taxable.

If a type of income is not listed above, it does not affect the claimant’s award.
H5003 Unearned income also includes unearned income which the claimant does not actually possess
but is treated as having . This is referred to as “notional income”.

Gifts from family and friends cannot be classed as income. They are capital. If the capital does not go above £6000 by the end of an assessment period, no deduction will be made.
