Question about the fines for 'the rule of six'

I've seen a lot of people (here and elsewhere) talking about 'a criminal record' for breaking the rule of six. Is this actually correct - i.e. will those who break the rule really be convicted and given a criminal record, or will they be issued with a one-off fine, in the manner of a parking ticket or similar? I don't have any major plans to break the rules, but this is something I feel it's important to clarify because there is a big difference.

I was under the impression it's a fine to start with (£100) and doubles every time you break the rules - so they must keep a record to know that - not sure it's a 'criminal record' as such though. They do have powers to go bigger with the fines and arrest you etc if you really flout the rules like with big raves etc.

I’m hoping it shows on DBS as then it may deter a few more people. If it’s just a fine many won’t comply.

I agree - I think there will be a very different level of compliance depending on whether it shows on DBS or not.

My own view is that the rule is very stupid in a number of ways but, even if it were just a fine, I would broadly comply with the spirt of it in the interest of doing my bit, but may occasionally break the letter of it - e.g. have an extra child in my garden. But if it's an actual criminal record, I would be more cautious. Which proves your point above IceCream about level of compliance. So it feels like a pretty important thing to me for the government to clarify?

If you need an enhanced check, then it may be included if it is considered relevant. It's more likely to be considered relevant if you have been fined several times, as that shows a disregard for the law.
