Am I within my rights to ask for postage to be refunded...

I bought the blue HSM microphone on the Boots web site but they have sent me the pink one. I phoned up the care line but they said that they have the same product number and I may get another pink one if they order me a new one. They recommended that I phone my local store. I did this and they said that they don't stock the blue one anymore as it is last year's (dd's a bit behind).

I wouldn't mind if it was exactly the same except for the colour but it has different songs on it. Am I within my rights to ask for my postage money back considering they have sent me a different product and I wouldn't have placed the order if I'd known it was going to be the pink one?

Did the advert say product may vary?

yes, absolutely

I've just cut and pasted this from the boots website:

Sing along with the music or sing along on your own!

Colours and styles may vary

Requires 4 x AAA batteries

Suitable from 5 years

I think Boots would refund you as their customer service for online shopping is in my experience quite good - however I don't think they are actually in the wrong on this

Hi, thanks for the replies.

On the product description it says:

'Feel like one of the gang as you sing along to the hit High School Musical tunes including 'Start of Something New' and 'Breaking Free!'

The pink one doesn't have these songs. Wouldn't style just relate to the appearance?

I'll phone them later to find out where I stand.

Good point! I hope you get your money back, I'm sure you will!

There are some blue microphones on ebay for a comparable price. You should be able to contact the seller to confirm the hue of microphone for sure before you buy - perhaps that is the way to go?

blue microphone

BTW the pink microphone is £6.95 from John Lewis and there is free delivery on everything if anyone else does want this toy.

Thanks mysteryfairy. I'll let you know.

Dh found one on ebay last night that was second hand but barely used and in excellent condition so we got that.

You are entitled to your money back including postage as the goods they sent are not fit for purpose.

The mistake was made by them and should be rectified accordingly.
