Can a dentist refuse to apply a sealant to Ds teeth....

A year ago he had a cavity in his baby tooth. He is 10 and is awful at brushing his teeth and moans when I do as he says his gums hurt. I've brought his a electric tooth brush and mouth wash etc and he brushes twice a day. I asked the de test about sealant as I am concerned his front bottom teeth are looking yellow and now I am worried ds will damage his adult teeth. The dentist said they are fine and said he didn't need them sealing. Anyway ds has been moaning about his loose tooth and again hasn't been brushing it or letting me. I brought mouth wash and told him to brush it gently. Anyway it has fallen out and has a w hole in it I am horrified!!! Luckily it's another baby tooth but I am at a loss at what to do.
I have now told him no sweets, juice or surgery stuff from. Ow on until he starts looking after them
