Restrictions on Romanian au pairs?

Does anyone know whether there are any restrictions on taking on a Romanian au pair other than them needing to get an accession worker card?

An agency said today she'd heard a story where one already over 26 had slipped through the net but the Border Agency caught up with him & refused to allow him to continue in the job he'd found. Only I cant find that on the border agency website...

Domestic workers/Au-Pairs only need the Accession Worker Card as far as I can see.

Form BR3 looks a little out of date, as it still contains Au Pair as a category. But if UKBA are still accepting that (the form is afterall still live on their website) then I guess for purposes of the Accession Worker Card UKBA are still using Au-Pair as a job title.

Aupair has to confirm:

  • I am coming to the UK for the purpose of learning English
  • I am unmarried, am not in a civil partnership and have no dependants

They have to enclose a letter from you which states:

  • applicant will help in the home in which they are being placed for up to five hours a day;
  • applicant will get at least two days off a week;
  • applicant will get an allowance and their own room;
  • applicant is being placed with an English speaking family.

So this looks like the same terms as the old au-pair visa category... so the limit of 5 hours work per day, limit of 5 working days per week, requirement to study English.
