I'm trying to figure out how this works. Our situation is as follows.
Me and my 2 kids (DD6 &DS3) Dad are separated and have been for a couple of years but we share custody 50/50. I suppose kids live with me but he has them Thursday to Monday every other week and Friday to Sunday the weeks in-between.
I am not eligible for the 30 hours but the kids dad is. Can he apply for them? It says the parent they normally live with but as we are separated they spend pretty equal time at both houses. How does it work?

They will still have a primary residence which sounds like it is your house. Whose address do you give when filling out forms, like for school, doctors, who is claiming child benefit etc?

To not be eligible for the 30 hours for the 3yo you either don't work enough hours or earn over 100k.

If you earn over 100k then it's worth him collecting the CB anyways as you'd need to pay it back. So I'd get him down as primary address and he claim the 30 hours.

If you don't work enough hours to qualify but earn under 100k you'd get 15 hours so in that instance I'd just split the cost of the other 15 hours (if needed) between you and ex.
