CM CLUB:It's Saturday night..and im NOT WORKING ;-)..so can i ask a bit of advice please?

I started a thread last week about child not turning up, parents not answering calls/texts etc and i said that id got dp t post a letter including invoice and t&c through their door friday morn.

dp said both their cars were there, but curtains drawn(understandable as it was 8am)..but he went home that way later on and one of the cars had gone??...meaning 'someone' must be home(the mum i think, as she ses this particular car)

So....theyve got the letter, it tells them to ring me asap, it also says to pay over sue amount by ties next week.......what if they dont?..its NCMA contract but i didnt renew my member ship so they may/may not help enforce the contracts t&c?..so what do i do next if i still dont hear anything??..please help, am getting stressed over this now

Sorry I don't know how to help but what about phoning up ncma and see what they say? They can only say 1 of 2 things yes or no. But remember only to do it when no mindees are with you , but of course ncma will be closed then!

You may be able to use Money Claim (part of HM Courts Service), to recover the debt.
Also worth calling your liability insurance providers legal helpline - with most policy's you get an hours free legal advice.

thanks everyone, got progress report!

Mum text me while we were out, just got is as we got home so rang traight back(different number to the one i have for her?)...apparently she DID text me with her ds's hours for last week, but her 'new' phone wasnt working properly, so i may not have got it....she then said 'HOWEVER@ she has now placed him in xx nursery!(so basically bollocks about texting me with last weeks hours?, contradicting herself!) as i was no longer flexible(she can choose from 3 days that week, the otehr two days he NEVER came so ive strated my EYFS and NVQL3 courses on those days)..the days i was available for her were the ONLY days she ever used.

So blah blah blah...i told her she could have commnicated these thought with me and if i thought she needed a day i was doing course i maybe coukld have changed, same go's with another day when i never used to be able to have him), i also said that becasue she NEVER gave me notice of his days apart from the last 5 weeks(been here a year), how could i help out and swap around if i didnt know from one minute to the next when he was here?

ANYWAY...she SAYS she didnt have a contract..yeah yeah, so id sent her a copy of mine friday(thanks MO!)and she said that ncma suggest 2-4 weeks noptice not the 6 she agreed to from the start..i explained they can reccoment whatever they like, but its what is detailed and agreed and signed for on the contract that stands..so she HAD read the contract..so many contracdictions

So...ive given her 3 options...she pays up IN FULL 6 weeks notice plus last weeks fee...or...i take her to court and she will have to pay all costs when i win as its a legal document..and third, she can ASK nursery to postpone his start date and bring him here for next 6 weeks to get "what she pays for"!

ive told her last weeks fee must be paid to me by x date and that she must let me know of her descision by this same date otherwise i will assume she is not co operating and start court proccedings.

for F*CKS sake..I DO NOT NEED THIS RIGHT NOW!

Send another letter telling her that she need to pay whatever she owes you by - give her 7 days. Tell her that if you don't receive the money, you will take legal action to recover it.
In the menatime, go and see either a solicitor/NCMA legal helpline/CAB, or perhaps your liabiltiy insurnce providers have a legal helpline.

thanks Saltire, i didnt actually renew my member ship with ncma , but have legal protection with morton michel, so will speak to them tomorrow..hate this kind of thing, totally unexpected..although DP said he thought this it what she would do!..cant see the wood for the trees me eh!
