employment contract for live out nanny

Has anyone got a contract for a live out nanny on a word/wordpad document that they could let me have? I am about to employ a nanny and can draft employment contracts (I'm a solicitor) but it will take me an hour to alter an already existing contract to my needs as opposed to a day to draft from new with a demanding ds (5 months).

Have you hired a nanny before? If not I can make a couple of suggestions of things I would include in the contract (like SSP and a probationary period).

Thanks a lot. I have included both of those. My mother's a small business so I know all the short cuts you can take with SSP and bank holidays. Do people usually give bank holidays in addition to 20 days holiday?

Some do, some don't. You'll probably find most mumnetters do. But, I don't.

Also, definately pay her in gross!

Oh, and if you make it a fixed term contract there is no obligation to renew. If you don't make it fixed term and don't like her you will have to go through a redundancy and then can't hire a replacement. Fixed term also protects you from maternity leave/pay. (I'm going to be slaughtered for pointing this out)

Rules regarding bank holidays are changing - see BERR (formerly DTI) - Holiday Entitlement

Therefore I suggest you give Bank holidays IN ADDITTION to 20 days annual leave, else refer to the above for calculating annual leave.

I won't slate eleusis regarding the Maternity Leave thing, as being a male nanny I don't get Maternity Leave!

If using the NannyJon specimen contract, check the Gross Misconduct section and add in anything you consider to fit in this category as then it highlights to your employee, what would constitutes gross misconduct.

Try to put in what you mean by Nursery Duties - I feel the clearer you are in the contract, the less possibility of a dispute later on. I think you could have a clause saying that specific details of work related things are in an accompanying document - a Household Management Manual perhaps.

Oh shit. So now we have to give 4 more days leave. Can I still credit bank holidays as part of annual leave if I pay her/him for them?

And since there are more than 4 bank holidays this still saves me a bit.

Oh oh oh.... does this mean I get 4 more days of hols too....

Thank God my nanny employer days are limited.

Maybe I'll get two au pairs next time just to avoid all the employer burdon.

The way I see it is that you can still ask an employee to work on a bank holiday. The leave I think builds up as before, so if a bank holiday is taken, it now comes out of Annual Leave. see Holiday Entitlement FAQ for more info

"Can payment be given in lieu of the additional holiday?
Yes, until 1 April 2009, if both worker and employer agree. Four weeks? leave must still be taken as holiday in each leave year. For statutory leave entitlement accruing after 1 April 2009, payment in lieu will not be permitted"

Oh, so it's 24 insted of 20, but it includes bank holidays. And I think there are 8 bank hols (correct me if I'm wrong), so if people who now get bank hols on top of stat hols move to the new entitlement they will actually be 4 days worse off.

Oh well, four more days. I'll just have to grin andbear it... or call in sick. Just kidding.
