Holidays during Probationary Period

I've got an AP, but sadly for both us, it hasn't worked out so she is leaving, by mutual agreement, after 6 weeks. In my contract I specifiy 28 days paid holiday per year and that I don't want her to take holidays during the probationary period of 2 months. Should I pay her accrued holiday for the 6 weeks?

I would like to do the right thing as there are no hard feelings.

Yes pay the holiday not taken.

CelineMcBean · 10/10/2012 09:33

Legally you have to.

Agree with both of those.

Note that the calculation for accrued holiday not taken is 12.07% of the days worked or 3.63 days NOT 28 x 6/52 = 3.24 days.
