Advice Please Childminders......

Hopefully I am posting on the correct board.
I had a childminder but I decided to leave work. I gave her 7 weeks written notice (she only needed 6) 3 weeks before it was due to terminate the childminder went longterm sick (unpaid).
As I paid my fees in advance the Childminder had already had my money (£600+)
I gave her a few weeks grace to refund my money but she didn't. It's now been 5 weeks.

Ok. The question.
My childminder has now said that she should of had 6 weeks full paid notice - and as she was sick she only received 4. Surely this can't be correct? Her going sick was totally out of my control and unforseeable.

I would really appreciate your opinions

there is another thread about notice periods and cm sickness. If your contract says 6 weeks notice and not to include time off. Are you supposed to pay when she's sick? Anyway, see what the small print says about notice and also sickness.
