Hi, looking for advice.
I got a car in March. A week after I got this I complained about the gear stick jamming and making a noise when putting it in reverse. This ended up being the clutch needing full replacement. Then when this was getting done I also told them about a noise at the front of the car and was told they would check this. When I picked up the car they told me nothing to worry about.
2 weeks later the noise was still happening and it was getting concerning, so I sent the same video I showed them in the email and they told me to come in 2 weeks later. When they checked they told me my car had no oil. I asked them if it could cause damage to the engine and if they could check, and they said no, it’s fine.
Around a month later the car broke down. It took them over 3 weeks to pick it up as they kept saying I had breakdown cover with AA, but AA confirmed I never did. They then stated this was the battery and simply wear and tear, but in the invoice it says this may need to be checked as could be an alternator drain.
I rejected the car after they told me it was the battery as this was the 3rd fault and they took 3 weeks to pick up the car. They told me they never inspected to see if it was the alternator as I didn’t want a repair.
There was then communication back and forth and I’ve already put small claims through. The dashboard didn’t show me any warning that either the battery or oil was low. I kept asking them why the dashboard doesn’t work and also they have 3 different mileages on 3 different documents. They refuse to explain either of these and now say they are charging me storage fees.
After I told them I spoke to a lawyer they told me they aren’t communicating with me anymore. That night I got a registration confirmation from their warranty company stating I have warranty from September to March. I phoned them up and they said the car dealer has put I purchased the car on 2nd September.
Do I have any chance of winning this small claims case?
