First minor collision - AIBU to be annoyed!

I (red box) was sat behind a queue of stationary traffic and believed they were all turning left. As I needed to turn right, the opposite side of the road was empty and had a clear view I decided to overtake the stationary traffic, follow the arrows and turn right. The road widens and there's enough space for cars to go left and right at the end of the road. I checked my mirrors, signalled, pulled out and the van next to the lamppost (blue coloured box) decided to pull out and hit my car with the same spot on his van.
We both pulled over, exchanged details, he admitted fault, said he didn't check his mirrors or signal. I contacted my insurance company but I don't know what happens now. Im annoyed as my insurance price will likely increase.
I keep wondering if I did something wrong - I'd never intentionally cause an accident and both my children and partner were in the car. I now feel anxious about driving with them in the car, and driving in general.

I'd say there's fault on both sides, in terms of common sense and morals and what not, but IANAL so I can't say whose fault it is legally!

It doesn't look like there is room for two lanes of traffic, so you should have waited. So should he. You were both doing a dodgy manoeuvre.

I can't tell exactly where the impact is from that photo, but if you were going slowly enough and looking for hazards on your left, you would have seen him pull out. And if he had been checking his mirrors he would have seen you approaching.

Seems like FAFO to me! Sorry your car is bust and I hope everyone is okay!

It looks like a classic Cycling Mikey scenario where you should have waited until the road was wide enough to pass on the correct side. It’s really dangerous to just shoot down past a queue. And as you’ve found out people queuing longer than you (ie in front) are also waiting to turn right. If you’re going to do it, at least pass slowly and be ready to stop at any second. I think he should have looked, true, but this is partly on you.

Looks like a 50/50 to me. He should have looked but the accident was caused by you overtaking in an unsafe manner.

Whereabouts did he hit your car ?

@firstofallimadelight he hit the car on the passenger side, in front of the wheel. There was no time for me to stop or react in any way. I wasn't going fast, maybe about 10mph, he just turned straight in to me

In theory it sounds like his fault- failure to look when overtaking. But insurance companies will just argue it out. I once had a car accident where a car pulled out and hit the side of my car 60/40 his fault.

I would have done the same as you. The van driver should have looked. It could easily have been a cyclist or motorbike doing what you did.
