Is this fair or does it make sense?! Confused

So I have one day off per week which many of the staff at work do. I have bank holidays off paid too which we all do. My manager has messaged to say I need to either work my day off next week, with my bank holiday already being off paid. Or work it back another day other wise it’ll have to be fully deducted from my next pay check?

Er no. Provided you don’t get paid for your non working day then non working day is your non working day. If you work a bank holiday you are entitled to it off.

Erm nope that’s not right bank holidays are pet of your contracted leave and you day off is your contracted working hours

Then you take a picture of this part of your contract and respond to your manager stating you won't be in as per your contract.

Your manager sounds like a colossal idiot to not comprehend how bank holidays work...

If that's what your contract states then fair enough for you to say no. But usually if you work part time then bank holidays, annual leave etc. are pro-rata. So for example I work 3 days per week, so I get 3/5 of the bank holidays given to me as extra leave. I then have to use that leave to book off a Bank Holiday if it falls on one of my working days. As it happens I don't work Mondays, so actually get to use that leave for other days off instead.

Does it not mention 'pro rata' relating to bank holidays in your contract?
If not then contract rules and if they deduct wages then you can get this back via 1. Formal grievance, 2. Via employment tribunal/acas.

I understand what they are getting at. A ful, timer has 20% off every time there us z bank holiday, you are having 25% off. Not your problem, brought about by whoever wrote the contract (statement of particulars).

Perhaps give them a copy of the contract?

This is how it works in my place too.

Be absolutely sure that your contract states this as it's highly unusual that you don't have to take it prorata
