Help with universal credit and esa if anyone can help

I am in the support group for esa. I have seizures, narcolepsy and fibromyalgia

my husband has had to go part time in his job due to being diagnosed with MS. So we have claimed universal credit.

universal credit are sending me for a work assessment and say I need to provide sick notes yet my esa is still up and running.

I have been given 2 different pieces of advice one by a disability charity and one by CAB

the first is universal credit conduct there own fit for work assessment

the second is tell universal credit to back off and they have no right to send me for another assessment ans send me sick notes if I am in the support group for ESA. The guy at the charity got quite mad on my behalf saying universal credit try and do this all the time.

please help I have done the assessment for pip and esa in the last year the thought of going through another one just breaks me.

I would say that you've had advice from the named disability charity and see what UC come back with.
If they go ahead with an assessment you'll be given a UC 50 form to fill in.
It then goes through a phone assessment.
I won't sugar coat it ,it's a stressful process and hopefully you won't have to go through it.
We went through it and DWP finally relented that my Dw was only capable of working x hours due to disability.
Some of the suggestions from the assessor were so wrong and out of touch.
My Dw wasn't looking to give up work,she has a lot of disadvantages and wanted Those considered.

The disability guy is correct. You are in the support group and do not need to hand in fit notes or be assessed again. Leave a note on your journal under 'payments' and say that you are in the support group of ESA and you should automatically have the LCWRA element added to your UC claim and not have to hand in fit notes or be assessed. It is regulation 19 transitional rules regulation. It is the same Work capability assessment for ESA and Uc and you don't need another one. The only way they could insist on another is if you were due for a re-assesment anyway which if you were only assessed recently doesn't sound like this is the case. I'm not surprised the charity guy got cross because he is correct that UC are always trying to do this and a new assessment is not necessary.
UC just need to request the confirmation form ESA that you are in the support group. It can take a little while for them to do this.

It's such a minefield...I detest the threads that say benefits are easy money,it's anything but.

Yep just send a journal message saying you are in the support group so should get LCWRA. Your case manager should pick that up and apply it. Make sure your husband has put down he is caring for you as well so he gets the caring element and that will stop any work requirements for him.

Put a note on your journal that under Rule 19 you automatically qualified for LCWRA as you migrated over from ESA Support Group. Also tell them you want it escalated to a decision maker and your payments backdated to your UC application date.
