You need to contact Citizens Advice. They can answer this. Most Local CABs have a web chat enquiry function now.

It depends on what is on your payslip as UC don’t take third party deductions into account.

So for example if your payslip shows:

£500 working hours payment
– £500 deduction

Net pay £0

It is the £500 working hours amount that they will take rather than the £0

Not exactly the same but my work overpaid me by 11 hours a week for a month. They reduced it by the same amount the following month. UC took the lower wage but called me in for an interview to explain why earnings suddenly dipped.

They were quite pushy about it although I tried sending an explanatory message on the journal.

SUNFLO · 20/12/2024 09:26

it's not third party
it's overpayment of wage last month x

It is a third party deduction for UC purposes. It’s a payment taken directly to the person it is owed to (your employer).

For this month, you should get your maximum UC allowance, as RTI will have reported your earnings as nil.

That's what has happened with a client of mine who was overpaid for 5 months. They've just clawed it all back from her final month's pay.

I've raised an RTI dispute, as she will have been underpaid UC for those 5 months.

Right, if it looks like you received nothing they pay you as if you don't have a job and set up a work coach call 'to help you get back into work, during that call you can explain the situation.

I had this when I got two wages one month and none the following. I had asked them to redistribute it in the journal but they were adamant the money was mine. Unsurprisingly the money was not mine and I had been right.

Because I had then been over paid UC they then just deducted it from future payments, I never had to physically give the money back, that was all automated.

SUNFLO · 23/12/2024 18:59
