Would you go to prison or be prosecuted for this action?

This is not about someone I know personally going through this situation but just wondered.

If a young person causes a car accident by driving on the wrong side of the road by trying to overtake another person and no one dies or is seriously injured as a result of the accident. The person has no alcohol or drugs in their system as well.

Are they prosecuted and what would a typical sentence look like?

Would it be classed as careless or dangerous driving?

I know someone who did this - they were banned (2 years if I recall) and had to do community service.

Prison would be highly unlikely unless someone was seriously injured or killed.

I think they may be charged with dangerous driving which can lead to a prison sentence.

Well what happened? There is a huge span of options.

Were they overtaking on a wide, straight road, within the speed limit and had some bad luck and slipped on some leaves?

Or were they breaking the speed limit and overtaking on double white lines in bad lighting on a bend while mucking around adjusting their music in a completely idiotic and reckless nature?
