Hi ladies. Daughter’s husband has recently walked out on her & their 3 small kids (10,7,5). They share a mortgage and the value of their house has increased since they bought it. He’s now saying he wants to sell the house. Can he force her to sell? Has anyone experience of a similar situation? Or any suggestions of the best place for her to get advice (CAB have not responded for 2 weeks)

She needs proper legal advice.

It will depend on their circumstances. Can she afford to buy him out?

She needs legal advice. He is entitled to his share of the equity so either sell or she can buy him out. However if they are going to divorce then what can happen depending on other assets/pensions etc is one can keep the house in exchange for not touching pension for example if amounts are equal and agree. However on divorce both need to be able to house themselves, so he is entitled to his equity to do that.

Hadn’t thought of the pension aspect. Thank you. Will make a note on the list of questions to go through with a solicitor.
