CMS zero ??

What to do?

did a CMS claim for exDP, he was being difficult and I wanted to minimise the contact I have to have with him. We’ve reasonably amicably coparented for years but he’s increasingly letting our DD down and I’m struggling to bite my tongue.

CMS have awarded zero

he along with his business partner is a tradesman, he’s working all the time (constantly late to collect DD because of work) earning around £1k a week if not more

he has her 2 nights in every 3 weeks - maybe 10 extra over year in school holidays. He doesn’t have anywhere for her to sleep so she always stays with his parents.

he has a child with new partner who works part time. She also has a child from previous and recieves maintenance from her ex.

how can the award be zero?

is there any possibility other than he’s lying about his income? I thought even then there was a flat rate?

he’s immediately stopped paying the measly £40 a week he had been.

i don’t know what to do, DD is 13 and I’ve never said anything bad about her dad but I’m so furious with him for just dropping any responsibility whatsoever.

Report to hmrc and dwp for benefit fraud.

Even if on benefits it's £7.50 a week.

Report him to HMRC.

Yes I think this is the next step, don't tell him you've done it

My ex pays 23 quid a week when I know his actual income is 100k. He has no other kids. He’s been on two holidays last month and rents out an apartment with a pool. The system is broken

Disgusting

Managed to speak to cms on phone who confirmed he’s only declared benefits income so they are going to do a mandatory reconsideration. Not holding out much hope based on what everyone has said.

it’s totally changed my opinion of him overnight. Thank goodness I’m not still with him.

You can report him for benefits fraud too then

If he’s registered as a sole trader, he doesn’t have to be listed at Companies House, but he does have to register with HMRC. They won’t disclose income to you, but surely CMS could find out? However, there are a lot of legal ways of minimising self-employment income for tax purposes, and since he has another child as well, it is possible that you still won’t get much.
