My child's ehcp hasnt been updated since 2021.

You’re best asking this to be moved to a SEN section as loads of knowledgeable people over there.

Has it been reviewed? It should be annually. Sometimes they’re reviewed and changes agreed but very delayed in having the changes made to the plan.

Well how old are they? They are generally updated before a stage transfer so EY to KS1, KS1 to KS3 etc. Do they have a transfer coming up? When is the annual review? You can request changes then.

KS 2 not been reviewed since 2001. No changes. No amendments.

Has the EHCP been reviewed but just not amended? If so, after ARs you get the right of appeal so you could have appealed if you thought the EHCP needed amending but the LA did not agree? When is your next AR due? Unless DC was in an infant school the EHCP wouldn’t necessarily have to be amended for transition from KS1 to KS2.

Why do you feel it needs amending? When was the date of the last AR and did you recieve a letter from the la saying that they intend to maintain tje plan with details of mediator and you're right to appeal?
Has the child met any outcomes?
Is there any evidence that it needs amending?
Did you discuss your concerns at the AR?
Does the child have any needs which aren't included?
Is there any provision that needs to be included that isn't currently detailed? (Is the provision specified and quantified in section f with every need detailed in section b with provision to meet each need in Section f? - if not do you want to amend to rectify this?)

Best bet is to get in touch with sossen

It should be reviewed every year by you and the school senco. After that the LA should amend it but it my area that isn’t happening and the amendments are still there only in draught form.

Are the school not carrying out an annual review or is the issue with the LA?

EHCPs must be reviewed at least annually, but the LA does not have to amend each year.

Wow, that's shocking! Speak to SENDCO at school and ask for a review asap.

You, the SENCo and class teacher should be getting together each year to amend and update.

Sometimes the LA come to the review.

It is then sent to the LA who send you a draft copy which you need to agree if right.

The EHCP is then updated and sent to you and the school.

Get in touch with the SENCo to arrange a review as a matter of urgency. @AzkabanWitch

It may have been missed due to the pandemic or they may have one heck of a backlog, although my DD'S was done via teams during lockdown so there was a way.

I'd really just contact the school first. Getting in contact with anyone from the EHCP team is nigh on impossible and they will just need to ask the school to set a date for a review anyway.

As others have said it definitely won’t be amended annually - the workload involved in that would be impossible - but it should definitely be reviewed. It will most likely be amended on transfer to secondary where Section I (school) will have to be changed. Are there other amendments you particularly wanted included?

Contact LA and school. As a parent you can request an EHC plan meeting any time. You don't have to wait for it to come around. (I would demand one before the end of term, and if they ask 'Why? It's not scheduled ' or some other fob off say as the information is wildly out of date).

You have the right to request an early review, but the LA does not have to agree. There’s no right of appeal if they refuse.

I’d contact the school if the review is overdue. If it’s been reviewed and not amended, that’s quite standard in my area. Only massive changes result in an updated plan.

From your other thread, I see the EHCP has been reviewed, but the LA has not amended. They do have to. If you disagreed, you could have appealed. Do you have the right of appeal now?

Can you give some more information?

How old is your child?
Are they attending a mainstream school?
Have you had termly meetings with staff?
Have you had annual reviews with staff?

It entirely depends on whether the content is still relevant. Annual reviews don’t always necessitate an amendment to the plan.

Plans are always updated to name a new school e.g. transition to secondary. I’ve just dealt with one that hadn’t been updated in 3 years because there hadn’t been any need to. Outcomes can often still be relevant and the supporting IEP contains the minutiae and the smaller steps. Not a huge deal unless you think there are significant changes to the child’s need in the interim.

If you do, have a list, and contact your SEND officer.
