Ladies we have heard it allll but this is next level shit! So I’ve got a friend who can barely hold a job down not because she lacks performance but her ds is on ehc plan! Up until he had his one on one she was constantly dragged out of work due to meltdowns etc.

Anyway they discovered his disability was that severe he will remain on a ehc plan until adulthood! The school advised her to claim dla for missed work etc how hard work he is destructive etc.

So she rings dla gets the forms sends them off…..to get a response that there is already a claim in place for this child? Only to discover his dad who has him overnight once a MONTH is already claiming?! Pays no cm nothing!!!

So mumsnetters where the fuck does she stand??? Any urgent help greatly appreciated no I’m not bullshitting or trolling. Surely this is FRAUD.

Have the DLA said it's fraud?

Fraud, you have to care for a child for at least 35 hours a week to claim DLA- this is froma GOV website

Yes she needs to prove that the child is in her full custody I assure you he is but there is no legal paperwork the dad was that much of a dosser and non existent Dad popping in and out of his life that she accepted his terms of seeing him!

They knew very early on DS wasn’t right but she didn’t know anything about dla! Her child’s 8 she could’ve rightfully claimed when he was 3! Where does she stand? No clue how long the dad claimed for.

How has he managed to do that with minimal contact and if she's only just been told to claim it then surely there wasn't enough evidence before that point?

Apparently he had reports from nursery sendco etc but DF had nooo idea about dla! He had alot more to do with DS years ago not enough to warrant dla but enough to keep in touch with nursery etc then his interest in his child diminished

She needs to go back and contest her Ex's claim, I presume she can offer some sort of proof he's only with his Dad once a month. I'd get her to go through all emails, texts etc and see what she can find as evidence. If the CF doesn't pay anything towards his DC's upkeep I'd absolutely feel no guilt about turning him in

I would say his interest diminished once the money started coming in

The school where under the assumption she knew and claimed after breaking down ds broke 3 tvs in two weeks! She said to the sendco team at the school I really don’t know how to finance this! Believe it or not nursery’s and schools do not advise DLA at allll!

This is a lady that hasn’t claimed a benefit in her life.

Exactly that I think the rugs coming up from underneath him ! Do you think with school records etc that’s enough evidence to insinuate he has never had custody of that boy?

Thanks very helpful yes she has phone records very few and far between no issues there, she can also provide evidence that she was the one point of contact and his living address? Would that make a difference
