Can I apply for jobs on Mat leave?

I am currently on maternity leave from my job in the NHS. I was wondering, if I apply for a new role within the NHS (same hospital etc) while I’m on ML, and if I were to be offered the job, could I just not return to my old job, and start fresh at the new? Or would I have to go back to my old role for X amount of time?

I have been trying to get in touch with my old manager to discuss my return to work, for over a month, with no reply. When I’ve asked colleagues if there’s anyone else I can speak to, the impression I’m getting of my old department is that it’s in absolute chaos and people are leaving left right and centre which isn’t making me hopeful about going back. I’d like to apply for something new but I’m just not sure how it works while on ML. Any advice is very welcome!

You would have to give notice as usual. And if you received additional pay (above statutory) you may have to return for a bit to avoid repaying (although if you're staying in the nhs this might not be the case).

I applied for a new job from maternity. Gave my 3 month notice period in time to coincide with my intended start date and that was that.

@stackhead even if the new job is with the same employer (NHS)…?

OP I don’t think there would be a problem as if appointed it would be continuous service for same employer/Trust.

Personally I think I’d apply and have some conversations with HR/new/old mgt before accepting the role if offered.

Above Pp is mistaken, if you stay in the NHS for 3 months after your may leave (including any annual leave block you take), even in a different trust/grade/drop hours etc you don’t have to pay your enhanced maternity leave pay back.

if you are successful at interview you’ll have to give your notice as usual, but if it’s internal, many managers wouldn’t expect you to come back to your own role and allow you to wave the notice period to start immediately in the new role, in my experience. Unless there’s very little time between your appointment and your planned RTW date in the original dept.

if you can’t get hold of your manager, just submit anything in an email/letter and cc their PA if appropriate
