To claim Child Benefit if DH and I are separated?

I used to claim until the new rules came in whereby if one of you earns more than £60k you are no longer eligible. DH and I have now separated (still living in same house for few more weeks/months until things are sorted). I have returned to work earning £32k.

We have 3 DC - can I put a claim in or do I need to wait until I move out to show some tangible evidence of our separation?

You can claim from when you officially separated. My friend has recently done this and is in the same circumstances as you and that is what she was told when she phoned to ask.

Thanks for replying. I'm not sure what constitutes 'officially'. Is that just the date we agreed verbally that we are separating?

AFAIK you can have a family lawyer draft a basic separation agreement for you, which could be helpful to come back to down the line if things get messy or questions are raised. You can I believe just draw one up and sign it yourselves, or download a template, but that's less likely to stand up in court.

I'm in Jersey so maybe slightly different here but my EXH and I had one as we'd not been married long enough to start divorce proceedings (min. 3 years here). It just stated the date we'd separated and a couple of financial bits, as we didn't have DC.
