Hello! Haven’t posted in a while but needing some help because I’m in a sticky situation and I think I’m being a bit dim but I can’t make out what my tenancy agreement means!
I am needing to move to be nearer to family for support because my son is autistic with severe learning disabilities and as he is getting older and still not progressing, I want to be in an area where they have good SENCOs and to be near better special needs schools for him (he’s nearly 3). His needs have become more apparent over the last six months and me and my partner could really do with more support from family who we currently live an hour away from.
We currently see Portage & he’s been referred for speech & language but tbh the system in my area is really struggling and we’re not seeing the benefits at all. The area where my family are is a much better system.
Anyway, that out of the way, I signed a tenancy in November 2021 for two years, with a break clause included.
I called my landlord to ask what our options were and he didn’t sound very happy, he said that the break clause is in February and I had to give two months notice, if it wasn’t at least two months I have to fulfil the rest of the tenancy (a remaining 10 months).
However I have looked at my agreement, and it says ‘The tenant is allowed to serve notice at any time after the first full 15 months of the contract have been served by the tenant giving one months notice in line with the original start date”.
Does this not mean that legally I am able to serve one month’s notice from February? Am I getting it wrong?
