To not want neighbours extension build on our wall?

Our original kitchen was tiny. We had an extension done which is full brick all the way round. Our neighbour is doing the same. They are only building a stud wall though that they want to attach to our property. Meaning our wall will be taking the full weight of our roof and theirs.

I called the council to check with planning and it turns out they don't have permission. They will come out and inspect but couldn't tell me when. Am I within my rights to tell them they can't attach this to our wall? Surely they need to build their own wall where the yellow bit is on the photo?

They need to come to you with a party wall agreement.

and no they can’t just build on your wall

They can't build on your wall. I would try and speak to them before it all kicks off ..

Thanks both. We don't even know who the new neighbours are. The builders speak very little English. They pointed to our wall with a piece of wood and said Stud. Hoping the council come out soon.

I would talk to your neighbours before they start the work as it will be very difficult to retify once work starts...

No they can't. What if you wanted to demolish your extension in the future?

Have you built right up to the boundary, or is there a gap for guttering?

You could get the deeds for land registry and find the owner's name. You could do with it being very unique to find them though.

You need to tell them that they cannot build their extension using your property as part of it , possibly via a solicitors letter

You need to nip this in the bud immediately. Tell them in writing you do not and will not agree to this. If they continue you would need to apply for a Party Wall Injunction.

Thanks everyone. My DH has managed to contact the owner. He seemed surprised we weren't happy. He has told them they can't do it so hopefully they are going to build their own wall against ours.

We have built up to the boundary. The guttering is over our side above one layer of the outer wall if that makes sense.

We had planning permission for ours and an architect.
