Hi,

posting Here for traffic!!

can anyone advise where I stand in this:

ex and I share 1 child, 50/50 night split. I pay all clubs, swimming, sports, wrap around care, including the days he is with ex ect. He pays for food at his and some clothing

am I able to claim child maintenance in this instance? Does anyone have any experience in this!

No, you aren't entitled to any child maintenance if you 50/50 co-parent. I would not be paying for childcare on his days though, but that is something to discuss with your ex, not something you can get CMS to sort out.

As PP said nothing can be done through the CMS. I would get the childcare provider to bill you each separately for your own days though.

No, but you stop paying for stuff when his dad has him. Tell dad he is responsible for those days, whether that’s him using time off or paying for childcare. If he can’t, then it changes from 50/50 and use can then claim maintenance towards it.

He should be paying half of the cost of all clubs and for childcare in his days

If childcare is 50/50 split, you’re not entitled to anything via CMS as the baby’s father is deemed to be contributing equally to yourself - which it doesn’t seem to be from your post. To that end I would be asking him to contribute more to the activities and childcare, and maybe some clothing too.

It amazes me that someone can have their child 50/50 and still get maintenance, I have mine 100% of the time and can’t get anything
