I had a annual season ticket April 2021- May 22.
It was automatically renewed earlier this month ( I didn't notice at the time of joining).

I have emailed and phoned numerous times for a refund with no success.
It's £95 how do I get my money back?

I doubt it's a DD. I expect it's a continuous payment authority based on the OP's 16 digit card number.

It's not a straightforward one, OP, because at some point you'll have agreed to it being an ongoing payment (even if this wasn't particularly explicit).

Was it a debit card? You could try a chargeback although they'll probably argue the company's given you the service you've paid for.

I'd write a letter recorded delivery saying you didn't give explicit permission for a CPA and you'd like a full refund within 14 days.

If you hear nothing, wrote another saying 'LETTER BEFORE ACTION' and give them another 14 days to pay up else take them to small claims.

Make sure the CPA is removed too else they'll just take another payment next year.

Btw, you can cancel CPAs directly with your card issuer so worth doing that right now seeing as the company is difficult to get hold of.

Don't be fobbed off if your bank directs you back to the company. FCA rules mean you can cancel directly with the bank just like a DD.

I have copied the terms of the auto renewal below (in italics).

The important point is that they promise to contact you before renewal. If they did not do this then the renewal is null and void. Also this notice of renewal should explicitly give details of the steps required to stop the renewal, and if they contacted you but did not give you these details, then this is classed as an "unfair term".

Your Membership will renew annually. You will be charged at the end of the month, 12 months after the date your Membership started. Annual renewal will continue until you contact us on 0121 348 8263 or email [email protected] to opt out of your annual renewal.
You may opt out of annual renewal a minimum of 3 days after initially purchasing your Membership.
We will contact you shortly before the end of your Membership to let you know that your Membership will be due for renewal.
If you fail to pay Birmingham Museums Trust within 3 days of the renewal deadline you will be contacted and given the opportunity to pay the outstanding amount or cancel your Membership.
If you fail to pay this amount by the required date your Membership will immediately cancelled.
BMT reserves the right to terminate your Membership if in its reasonable opinion you behave in a way which is considered to be harassing, causing distress or inconvenience or you breach any of these terms and conditions.
Subject to any statutory right to cancel, your Membership Fee is non-refundable once payment has been received by BMT.

I have emailed them now.

I didn't receive a reminder/ notification.
And I can't remember seeing the auto renewal part when I signed up.
They gave made this really difficult.

When I first emailed then they did reply to say they have cancelled next year's auto renewal, and ignored the part where I asked for a refund for this year's. They have ignored all other emails.
That was a different email address to the one below so hoping this will be successful. [email protected]
