Car accident not to blame

Last week I noticed that there was obvious signs that someone had hit my car, nothing major a little bit of paint transfer on the wing and some on the side bumper, no dents or anything of the sort so wasn’t bothered about it.

I no longer use my car daily as I work In central London so use public transport, so my car is parked up outside my house most of the week.
Anyway I received an email from my insurance company yesterday outlining that I had been in an accident, me being me thought wow what a nice person they have informed their insurance they have damaged my car as there was no note or anything left on my vehicle.
only for my insurance to inform me that they are in fact claiming that I am the one who has hit them 😡

I explained to the insurance company that I am completely not at fault and can prove that I was in fact at work at the time of the accident, I am the only driver of the car and that this is a completely fraudulent claim.
They have said that as it will be my word against theirs, it will likely end in a 50/50 settlement which in turn means I will now have an at fault claim on my driving record and my premium will go up.

So is there anything at all I can do to stop this from happening? I am absolutely livid that someone can do this and get away with it.

You need to absolutely deny that you were in the car at the time. Do not accept the claim.
My DD had a fraudulent claim against her and the insurance company went all out to prove she was not at fault.

Is there any info about where the accident happened and if so could you see if there was any CCTV around to help you? I'm sorry, it's a really horrible thing for someone to do!

Itloggedmeoutagain · 09/06/2022 08:11

Train ticket?
Proof that you were at work?
Any cctv near where your car is parked to show it didn't move?
Surely they need a witness

Afterfire · 09/06/2022 08:13

Do you have some sort of Facebook community notice board you could ask whether anyone has cctv of your where your car was parked? (That happens a lot on ours and sometimes people are lucky)!

If you travel via public transport can you provide evidence that you travelled on that day and therefore didn’t use your car?

Insurance companies are buggers for this. Someone hit me, admitted fault at the scene but my insurance company told me that if he changed his story, it would go 50/50. I was stationary at the time he hit me!

Thankfully he was an honest and decent person but it's a shocking system.

We're going through this at the moment except we were in the car. Insurance company are fighting it all the way though. She's outright lying claiming personal injury even though she reversed into us. Barely made a scratch on the car though and no marks on hers so she doesn't really stand a chance. Court case is September

They’ve said the accident took place on a road just by my house, there is no cctv evidence which of course is always the bloody case.

My manager has said she will provide me with a letter to say I was at work and at what time I left, also as I use my phone as an oyster it will show what days I used public transport.

Its just shocking that people are like that, if I was in the car when it happened with the amount of damage I would have just told them not to worry about it as it’s so minimal that it would come out with a good T-cut.

Go along the road and see if you can find anyone with ring doorbell showing the traffic on the road. Might show his vehicle.

I did knock on a few yesterday, but nobody was home so will try again later.

Spoke to my insurance again today and they’ve said they’re willing to fight it as I explained the road the third party is saying it happened on would be practically impossible for me to even cause damage to their car unless I was driving on two wheels.
