AIBU over wrong item received?

I ordered a pair of boots from Spain, so on top of the cost of the boots and the shipping, I also had to pay just short of £60 customs tax. The company have sent me the wrong size boots. I've been back and double checked I didn't order the wrong size, they've sent me a 6 when I ordered a 5. Am I right in thinking that because it's their error, it's on them to put right? Not on me to pay to send them back to Spain, and then pay another lot of customs tax when they send the correct pair? AIBU in thinking this is their mistake to correct?

YANBU i would expect the to pay the postage to return them, send the new ones and any customs fees incurred

If you're in the UK, then I don't think EU consumer protections will apply since brexit. They may apply them as a courtesy though, so worth asking them.

They still apply, because Spain is still in the EU. Spanish customers buying from Britain wouldn't have the protection, not the other way around.

@BrilliantBulb very little, once I'd sent them screenshots showing what my order confirmation said, and what they'd actually sent me, they've stopped replying to me.

Raise a credit card dispute? It won't get you back the £60 customs fee though.

Well Spain might be in The EU but we aren’t and this article suggests that you won’t benefit from EU consumer protection

I find euro sizes hit and miss and I've lived in europe for 11yrs. Some 39s are more a 5 and 40s more a 6 in my experience.

YANBU but in reality it will probably fall down to you if they have stopped replying.

What about sticking 2 pairs of socks on? This is what I would do, or shove them in a cupboard and huff about it whilst never actually wearing them, than go through the arsehole of returning them to Spain.

Have you tried them on? They might feel ok.

Did you pay them through Paypal? If so raise a complaint through there, you'll get your money back that way

They're too big on the foot, but as the sizes go up, so do the calf width, so they're also a bit baggy around my legs.

It might. When I had a similar dispute, my credit card company paid all expenses.

While they might apply theoretically, I don't think you'd be able to enforce them too easily from outside the EU.

I've had a very snotty email to say they 'made them for me expressly' and if I want to change them I'll have to return them Sad. Seems silly to spend another £120 just on customs charges and shipping
