AIBU to take Thomas Sanderson to court?

Since 6th May ordered curtains from Thomas Sanderson. The catalogue of errors are too long to list. Suffice to say the after number of dates to fit came and went with nothing, about 3 weeks ago 2 out of the 4 curtains were fitted. One is not fitted at the end, the other set the curtains are not cut straight. The fitter could not get his steamer to work and said he would be back later that day. Never showed up again. 2 badly fitted set of curtains and two missing curtains. All attempts to get them to set out a way forwards ends up with them blaming the fitter and the fitter blaming them. I am in limbo. 2 weeks and no calls from them. I wrote them twice under the Consumer Rights Act 2015. Still no sign of when this will all end. I’m near a nervous breakdown with this.

AIBU to just instruct a solicitor and take them to court?

I have honestly never experienced such terrible service in all my nearly 50 years in this earth.

Is it a small claim? Generally they’re done without a solicitor as the sum in dispute is too small to justify.

Did you pay on credit card? You could see if eligible for charge back to get refund?

I paid with debit card almost £3,000 part payment.

Good to know I don’t need help if solicitors although I thought they would add more pressure. I can access free legal advice and help.

If in the small claims court and you pay legal fees you won't get these back even if you win, thus eating into your refund.

Plenty of help online to self represent.

Thank you, I’ve contacted my bank about it and they’ve asked me to send some information to them.

I am angry that they are able to treat customers like this and that I have to go through all this stress. I wish I had never ever agree to buy my curtains from them. The service is truly shocking.

I think that you have to give them a chance to remedy the fault to your satisfaction before you take the matter further.
Goods have to be fit for purpose and it seems these aren’t.

Have you tried the press? The Guardian are quite good at getting these things sorted. Anna Tims is the journalist.

Vegas888, I’ve been so patient and wrote them formally twice. There is just no end in sight. I just can’t keep going on like this. Words can express how this is impacting on me.

We live in a main road. Moved in in April. No curtains when we moved in so really need the curtains. In the back room my 10 year son cannot sleep because there is no curtain and it does not get dark until after 9pm.

I only want what I paid for and they promised in the contract. I’m not asking for anything more nor have I been unreasonable. Far from it. I’ve been patient but I don’t have any more patience to give. This has burnt me out.

If you think this is going to take a long time to get sorted you could buy temporary paper blinds, I got some blackout ones once from Blinds In A Box.

Highly recommend the cheap IKEA blinds whilst you’re waiting, for your sons room. Also blinds2go for blackout rollers

In the meantime, I’d start a chargeback……if no joy go down the small claims route. This is awful. It’s so stressful, not being listened to.
